PLEASE NOTE: The Allegheny County courts recommend a specific paper-format of Pennsylvania name change documents, which are offered locally. Our products, though designed to meet state legal requirements, are sometimes denied by the clerks solely because Petitioners are not filing these "recommended forms". Other customers of ours have prepared their documents using our products, submitted them to the Allegheny Court clerk, and have never received a complaint or issue from the court. You may wish to contact your local court clerk or Prothonotary's office to learn more about the local forms and filing procedures for Allegheny County. This product is intended for use in simple, uncontested actions only. Our products do not address the following situations: Persons seeking a name change for a minor due to adoption. Typically a simplified procedure is available. Similarly, if the minor is under the age of one year OR if you are only correcting a first or middle name, you MAY not need to go through the court-ordered process. Contact the Office of Vital Records in the state where the minor was born, for information about name changes that can be obtained without going to court. Additionally, persons who have been convicted of a felony, have claimed bankruptcy, or have a lien or financial judgment filed against them should not use this product. In such cases, a licensed attorney should be contacted. IMPORTANT NOTE: Pursuant to § 703, sub-sections (a) of the Pennsylvania statutes (Title 54, Chapter 7), as a “General rule - Whenever an order is made under this chapter changing the surname of anyone who is at the time thereof the parent of a minor child or adopted minor child, then under the care of such parent, the new surname of such parent shall, unless otherwise ordered by the Court, thereafter be borne likewise by such minor child. Pursuant to sub-section (b) of this same section, “Further change on attaining majority - Any minor child whose surname has been changed pursuant to subsection (a) upon attaining majority shall also be entitled to the benefits of section 702 (relating to change by order of court). The Prothonotary's Office or the Clerk of the Court in your county should have information relating to this particular procedure. During a proposed name change for a minor, the petition must be brought by both of the minor’s parents, or by one parent with the Notarized consent of the other. All adults who retain legal rights over the child must be given proper notice of the proposed action. Courts typically conduct hearings to determine whether the change of name is in the best interest of the minor and hear any objections which may be raised by interested parties.
