PLEASE ALSO REMEMBER: When the change of a name is for a minor, the application for a name change must be brought by one or both of the minor’s parents, but if the minor has two living parents and one does not join in the application, that non-petitioner parent must be served with reasonable notice of the application and, if that parent objects, a hearing will be held to determine whether the change of name is in the best interest of the minor. If you anticipate that the non-petitioner parent will object and/or if the non-petitioner parent does object our product should not be used and a registered attorney in your area should be consulted. PLEASE NOTE: The Allegheny County and Lancaster County courts recommend a specific paper-format of Pennsylvania name change documents, which are offered locally. Our products, though designed to meet state legal requirements, are sometimes denied by the clerks solely because Petitioners are not filing these "recommended forms". Other customers of ours have prepared their documents using our products, submitted them to the Allegheny/Lancaster Court clerk, and have never received a complaint or issue from the court. IMPORTANT NOTE: Pursuant to § 703, sub-sections (a) of the Pennsylvania statutes (Title 54, Chapter 7), as a “General rule - Whenever an order is made under this chapter changing the surname of anyone who is at the time thereof the parent of a minor child or adopted minor child, then under the care of such parent, the new surname of such parent shall, unless otherwise ordered by the Court, thereafter be borne likewise by such minor child. Pursuant to sub-section (b) of this same section, “Further change on attaining majority - Any minor child whose surname has been changed pursuant to subsection (a) upon attaining majority shall also be entitled to the benefits of section 702 (relating to change by order of court).
