Contact the Office of Vital Records in the state where you were born, for information about name changes that can be obtained without going to court. Additionally, persons who have been convicted of a felony, have claimed bankruptcy, or have a lien or financial judgment filed against them should not use this product. In such cases, a licensed attorney should be contacted.

IMPORTANT NOTES: Resumptions of prior name are not filed as Special Proceedings in North Carolina – these are filed in the Civil Division of your local Superior County Court’s office. If you are a widow OR a woman who was divorced in North Carolina and wish to restore your name (maiden, the name of a prior deceased husband or previously divorced husband (if you have children with that husband’s surname)), you do not need to go through the Court Petition method as outlined here. Once you have a divorce judgment, you may resume your maiden name through the Clerk’s Office for a $5.00 fee. The resumption of maiden name forms should be located in the Civil Division of the Clerk’s Office in your local court.

Additionally, you may resume the name of a prior deceased husband or previously divorced husband (if you have children with that husband’s surname) by using the same forms as are located in the Civil Division of the Clerk’s Office. You will need a copy of the divorce or death certificate to attach to the application forms. To resume a prior name, you will need to fill out the application forms and bring a certified copy of the divorce or death certificate.
