Using state laws and other resources, this state-specific product has been designed to provide the necessary forms and filing instructions to conduct a legal name change for a minor. This product is intended for use in simple, uncontested actions only. Our products do not address the following situations: Persons seeking a name change for a minor due to adoption. Typically a simplified procedure is available. Similarly, if the minor is under the age of one year OR if you are only correcting a first or middle name, you MAY not need to go through the court-ordered process. Contact the Office of Vital Records in the state where the minor was born, for information about name changes that can be obtained without going to court. Additionally, persons who have been convicted of a felony, have claimed bankruptcy, or have a lien or financial judgment filed against them should not use this product. In such cases, a licensed attorney should be contacted. During a proposed name change for a minor, the petition must be brought by both of the minor’s parents, or by one parent with the Notarized consent of the other. All adults who retain legal rights over the child must be given proper notice of the proposed action. Courts typically conduct hearings to determine whether the change of name is in the best interest of the minor and hear any objections which may be raised by interested parties. If you anticipate objections, our product should not be used. In such cases, consult a licensed attorney in your area. IMPORTANT NOTE: In Hawaii, the name of a minor can be changed only by the Lieutenant Governor’s office when both parents consent to the change. If one parent does not give consent or cannot be located, they may obtain a change of name through Family Court. When the minor is ten years of age or more, the minor must consent as well. This product is ONLY to be used for a name change for a minor/child whose one parent is acting as the Petitioner and the other (non-petitioning parent) will provide written notarized consent (hence the application for change of name will be filed in the Lieutenant Governor’s office) and if the minor/child is ten years of age or older and consents to the name change. Additionally, please note, the Order issued by the State of Hawaii Office of the Lt. Governor is NOT a court Order (signed by a Judge). It is merely an Administrative Order (signed by the Lt. Governor). Most States require a Court Order before amending a birth certificate. As such, this Kit is primarily intended for Hawaiian residents who were born in Hawaii.
